been making observations of the foreshore for some years past

on behalf of the Government in this matter, shows that no silt-

ing caused by the reclamation works in fact took place, and that consequently the Petitioners' claims for intermediate

loss of rentals could not be sustained. It will also be noted

from the Police Reports for June to October, 1898, which I have

already referred to above, that the Petitioners' godowns were,

at certain periods during those months, quite full.

PARAGRAPH 37.

With reference to the valuations now put for-

ward by Messrs.Leigh & Orange, I am informed by the Director

of Public Works that better situated land on the new Praya to

the West of the Petitioners' Lot, namely, the land forming Ma- rine Lot 199, was sold at public auction at the rate of $2,90

per square foot.

PARAGRAPH 39.

The award made by the Officer lately Adminis-

tering the Government was not, as is alleged by the Petitioners

an arbitrary act, but was arrived at by him after careful con-

sideration and discussion with the Acting Colonial Secretary,

the Acting Attorney General, and the Director of Public Works, and he was doubtless actuated by an earnest desire to do full

justice to the Petitioners' claims.

It is not the fact that none of the Petition-

ers' evidence was disputed, (I have mentioned above one or two of the instances in which such evidence was disputed) and the Petitioners have not seriously attempted to substantiate their
